Responsibilities

Octo Pro Coatings will be responsible for professional delivery of the agreed-upon services, ensuring the highest quality standards. The Client will be responsible for providing access to the specified area and ensuring the space is clear and ready for the coating application.

Warranty Coverage

Our 15-year warranty covers against cracking, chipping, peeling, and yellowing of the floor coating. To activate the warranty, clients must submit an online form within 30 days of the completion of the service. Warranty Activation Form

Exclusion of Liability for Third-Party Workmanship

In the event that damages arise and it is determined that such damages are attributable to the workmanship, products, or services provided by third parties not under the control or supervision of Octo Pro Coatings, Octo Pro Coatings  shall not be liable for such damages, and they shall be expressly excluded from any warranty provided by Octo Pro Coatings.

Octo Pro Coatings shall not be held responsible for damages caused by the improper installation, use, or maintenance of products or services provided by third parties, and the warranty provided by Octo Pro Coatings shall not extend to cover such damages.

It is the responsibility of the customer to ensure that all products and services provided by third parties are installed, used, and maintained in accordance with manufacturer instructions and industry standards. Any claims for damages related to third-party workmanship shall be directed solely to the responsible third party, and Octo Pro Coatings shall not be liable for any costs, expenses, or losses incurred as a result.

Transferability

For original purchasers who may be relocating, the warranty is transferable within 3 years of the initial service. The transferred warranty will then provide coverage for an additional 3 years from the date of transfer.

Claims Process

To initiate a warranty claim, the floor must be examined by our team to determine the nature and cause of the issue. This assessment is crucial for determining the appropriate course of action.

Maintenance Requirements

Customers are responsible for maintaining the coated surface. Any spills or substances with a pH level that is not neutral must be promptly wiped off the surface within 30 minutes to prevent potential damage.

Payment Terms

The total cost for the services will be as outlined in the provided estimate. A deposit is required upon approving of the estimate, with the remaining balance to be paid upon completion of the job.

Rescheduling Policy

The Client reserves the right to reschedule the services with a minimum of one week’s notice prior to the scheduled service date. In the event that the rescheduling notice is provided less than one week before the scheduled date, the Client may be subject to a rescheduling fee determined by Octo Pro Coatings based on the nature and scale of the services involved.
Octo Pro Coatings also reserves the right to reschedule jobs in the case of natural acts that can cause moisture to be on the floor, ensuring optimal conditions for the coating application.

Cancellation Policy

The Client acknowledges that in the event of a cancellation of the agreed-upon services, a cancellation fee of $500 will be imposed if notice is given within a week before the scheduled service date. Additionally, if the cancellation occurs with less than a week’s notice, the Client will be responsible for the full price of materials. Octo Pro Coatings reserves the right to charge the aforementioned fees to compensate for any associated costs and lost opportunities related to the cancellation.

Photo and Video Usage Policy

Octo Pro Coatings may capture photos and videos during our services to showcase our work. By using our services, clients agree to allow us to use these visuals for marketing, including social media posts and promotional materials. We respect our clients’ privacy and won’t disclose any personal information without consent. Clients who prefer not to have their project featured can inform us in writing.

Insurance

The Octo Pro Coatings shall maintain general liability insurance coverage during the term of the engagement, with coverage limits commensurate with industry standards.

Limitation of Liability

The Octo Pro Coatings shall exercise reasonable care and skill in the provision of services. However, the Client acknowledges that our expertise lies in floor coatings, and while we can offer solutions for minor crack repairs, extensive cracks may require the attention of a contractor specifically focused on such repairs.

Octo Pro Coatings’ liability to the Client for any claims arising out of or relating to the provision of services shall be limited to the total fees paid by the Client to Octo Pro Coatings.

Modification

Octo Pro Coatings reserves the right to modify these terms, provided that the Client is notified in writing of any changes. Modifications will be considered effective upon the Client’s receipt of written notification from Octo Pro Coatings.

Term and Termination

These terms and conditions shall remain in effect until terminated by either party. The Client may terminate these Terms at any time by ceasing to use the services provided by Octo Pro Coatings. Octo Pro Coatings reserves the right to suspend or terminate the Client’s access to the services provided under these Terms at any time and for any reason. Upon termination of these Terms, the Client’s right to access and use the services provided by Octo Pro Coatings shall cease immediately.
