Terms and Conditions

Scope of Work

Octo Pro Coatings will be responsible for providing floor coating services as described in the estimate. The services include, but are not limited to:

• Surface preparation, including mechanical etching, cleaning, and any necessary repairs as outlined in the estimate.
• Application of the specified floor coating system as detailed in the estimate.
• Final inspection and touch-ups, if necessary.

The Client acknowledges that the services provided by Octo Pro Coatings are limited to those specified in the estimate and do not include additional work, unless expressly agreed upon in writing by both parties. Any additional work will be subject to additional charges.

Materials and Equipment

Octo Pro Coatings will supply all necessary materials and equipment to perform the services described in the scope of work. All materials used will be of professional-grade quality and will comply with all applicable building codes and standards.

Payment Terms

The total cost for the services is as outlined in the provided estimate. A deposit is required upon approving of the estimate, with the remaining balance to be paid immediately upon completion of the job.

Site Access

The Client agrees to provide Octo Pro Coatings with access to the job site. The Client is responsible for ensuring the area is prepared for the coating process, including covering of items to protect them against dust and the removal of any obstructions or items that could interfere with the work.

Rescheduling Policy

The Client reserves the right to reschedule the services with a minimum of seven (7) business days’ notice prior to the scheduled service date. In the event that the rescheduling notice is provided less than seven business days before the scheduled date, the Client may be subject to a rescheduling fee determined by Octo Pro Coatings based on the nature and scale of the services involved.

Additionally, if the Octo Pro Coatings team arrives on-site and finds that the area is not adequately prepared for coating, the Client may incur a rescheduling fee.

Octo Pro Coatings reserves the right to reschedule jobs in the case of natural acts that can cause moisture to be on the floor, ensuring optimal conditions for the coating application.

Cancellation Policy

The Client acknowledges that in the event of a cancellation of the agreed-upon services, a cancellation fee of $500 will be imposed if notice is given within seven business days before the scheduled service date. Additionally, if the cancellation occurs with seven business days notice, the Client will be responsible for the full price of materials. Octo Pro Coatings reserves the right to charge the aforementioned fees to compensate for any associated costs and lost opportunities related to the cancellation.

Warranty Coverage

Octo Pro Coatings provides a 15-year limited warranty that covers against cracking, chipping, peeling, and yellowing of the floor coating. To activate the warranty, clients must submit an online form within 30 days of the completion of the service. Warranty Activation Form

Exclusions

The warranty provided does not cover damages caused by Acts of God, misuse of the coated surface, and normal wear and tear. Additionally, as moisture is an important factor to consider when performing the service, no moisture should be introduced to the product or environment until the product is fully cured, which typically takes 30 hours after installation. The warranty coverage only applies if the coating is applied directly to bare concrete; surfaces with any existing materials or coatings are not covered under this warranty.

Exclusion of Liability for Third-Party Workmanship

In the event that damages arise and it is determined that such damages are attributable to the workmanship, products, or services provided by third parties not under the control or supervision of Octo Pro Coatings, Octo Pro Coatings shall not be liable for such damages, and they shall be expressly excluded from any warranty provided by Octo Pro Coatings.

It is the responsibility of the customer to ensure that all products and services provided by third parties are installed, used, and maintained in accordance with manufacturer instructions and industry standards. Any claims for damages related to third-party workmanship shall be directed solely to the responsible third party, and Octo Pro Coatings shall not be liable for any costs, expenses, or losses incurred as a result.

Transferability

For original purchasers who may be relocating, the warranty is transferable within 3 years of the initial service. The transferred warranty will then provide coverage for an additional 3 years from the date of transfer.

Claims Process

To initiate a warranty claim, the floor must be examined by Octo Pro Coatings to determine the nature and cause of the issue. This assessment is crucial for determining the appropriate course of action and it may include cutting and removing an area of the floor and sending it to the lab for testing. 

Maintenance Requirements

The client is responsible for maintaining the coated surface. Any fluid must be promptly wiped off the surface within 20 minutes to prevent potential damage.

Photo and Video Usage Policy

Octo Pro Coatings may capture photos and videos to showcase the quality of work. By using our services, clients agree to allow us to use these visuals for marketing. We respect our clients’ privacy and won’t disclose any personal information without consent. Clients who prefer not to have their project featured can inform us in writing.

Insurance

The Octo Pro Coatings shall maintain general liability and worker’s compensation insurance coverage during the term of the engagement, with coverage limits commensurate with industry standards.

Limitation of Liability

Octo Pro Coatings shall exercise reasonable care and skill in delivering services. However, the Client acknowledges that while the Octo Pro Coatings specializes in floor coatings, extensive crack repairs may require a specialist contractor.  

Octo Pro Coatings’ liability for any claims arising from the services provided shall be limited to the total fees paid by the Client.
